A. PAYMENT TERMS
NON-REFUNDABLE DEPOSIT
a. The hirer agrees to pay the amount of 20% of the total invoiced amount to JWBeatsEntertainment to secure the booking for the service and/or product.
b. The hirer acknowledges that the services and/or products will not be secured for hire on the requested date until the non-refundable deposit is paid. The booking security will be granted to the first hirer who pays the deposit.
PAYMENT OF THE BALANCE OF THE INVOICE
a. The hirer agrees to pay all outstanding amounts to JWBeatsEntertainment at least 21 days before the event date.
b. Failure to pay the outstanding amount to JWBeatsEntertainment 21 or more days before the event will result in forfeiture of the deposit and event cancellation unless otherwise agreed by JWBeatsEntertainment.
PAYMENT METHODS
a. JWBeatsEntertainment accepts payment by Direct Deposit (EFT).
REFUND POLICY
a. Cancellation by JWBeatsEntertainment
i. If JWBeatsEntertainment cancels the event due to the hirer’s failure to pay any outstanding amounts before the scheduled event, no refund will be provided.
ii. If JWBeatsEntertainment cancels the event due to misbehavior, misuse, potential safety risks to participants, or damage to the product, no refund will be provided.
iii. If JWBeatsEntertainment cancels the event 48 hours before the scheduled date (provided it is not a corporate event) due to extreme rain or wind conditions, a full refund will be given to the hirer.
iv. If JWBeatsEntertainment cancels the event less than 48 hours before or on the date of the scheduled event (provided it is not a corporate event) due to extreme rain or wind conditions and has not packed or loaded the products for delivery, or has not delivered the products to the event site, a full refund will be provided at the complete discretion of JWBeatsEntertainment.
b. If JWBeatsEntertainment cancels the event up to 48 hours before or on the date of the scheduled event (provided it is not a corporate event) due to extreme rain or wind conditions, and
i. has partially or completely packed or loaded the products for delivery, or
ii. has delivered the products to the event site, no refund will be provided to the hirer though a future credit less the non-refundable deposit will be provided to the hirer.
c. If JWBeatsEntertainment cancels a corporate event due to extreme rain or wind conditions up to 48 hours before the event date, and no packing has commenced for delivery, no refund will be provided to the hirer though a future credit less the non-refundable deposit will be provided to the hirer.
d. If JWBeatsEntertainment cancels a corporate event due to extreme rain or wind conditions up to 48 hours before the event date, and the products:
i. have been packed ready for delivery,
ii. are in transit for delivery,
iii. have been delivered,
iv. have been set up, no refund will be provided to the hirer though a future credit less the non-refundable deposit will be provided to the hirer..
Cancellation by the Hirer
i.
If: i. the total cost of the event is less than $1,000; and
i. the hirer cancels the event more than 4 weeks before the scheduled event date; and
iii. the event does not fall in a high peak season, then 100% of the deposit will be refunded to the hirer.
ii.
If: i. the total cost of the event is greater than $1,000; and
ii. the hirer cancels the event more than 4 weeks before the scheduled event date; and
iii. the event does not fall in a high peak season, no refund is available for the non-refundable deposit.
iii.
If: i. the total cost of the event is less than $1,000; and
ii. the hirer cancels the event more than 4 weeks before the scheduled event date; and
iii. the event falls in a high peak season, no refund is available for the non-refundable deposit.
iv.
If: i. the total cost of the event is greater than $1,000; and
ii. the hirer cancels the event more than 4 weeks before the scheduled event date; and
iii. the event falls in a high peak season, no refund of the non-refundable deposit will be provided.
v.
If: i. the total cost of the event is less than $1,000; and
ii. the hirer cancels the event between 4 weeks and 7 days before the scheduled event date; and
iii. the event falls in a high peak season, no refund is available for the non-refundable deposit.
vi.
If: i. the total cost of the event is greater than $1,000; and
ii. the hirer cancels the event between 4 weeks and 7 days before the scheduled event date; and
iii. the event falls in a high peak season, no refund will be provided.
vii.
If the hirer cancels the event within 7 days or less before the scheduled event, no refund will be provided.
viii.
If: i. the total cost of the event is less than $1,000; and
ii. the hirer cancels the event up to 48 hours before the scheduled event date; and
iii. the cancellation is due to severe rainfall or wind conditions at the event location, supported by the Bureau of Meteorology; and
iv. the products have not been packed for delivery, JWBeatsEntertainment will refund 100% of the funds paid by the hirer.
ix.
If: i. the total cost of the event is greater than $1,000; and
ii. the hirer cancels the event up to 48 hours before the scheduled event date; and
iii. the cancellation is due to severe rainfall or wind conditions at the event location, supported by the Bureau of Meteorology; and
iv. the products have not been packed for delivery, no refund will be provided to the hirer though a future credit less the non-refundable deposit will be provided to the hirer.
x.
If: i. the hirer cancels the event less than 48 hours before the scheduled event date; and
ii. the cancellation is due to severe rainfall or wind conditions at the event location, supported by the Bureau of Meteorology; and
iii. the products have been packed for delivery or have been delivered, no refund will be provided.
xi.
If cancellation occurs for any other reason not outlined above, a refund, if any, will be solely at the discretion of JWBeatsEntertainment.
DELIVERY PRODUCT
a. The hirer acknowledges and agrees that delivery of the products constitutes a lease of the product for the period stipulated in the invoice provided by JWBeatsEntertainment.
b. Title of the products remains with JWBeatsEntertainment at all times and does not transfer to the hirer.
CHARGES
a. The hirer acknowledges and agrees that JWBeatsEntertainment will charge an additional delivery fee based on:
i. The day of the week the scheduled event is set,
ii. Public holidays,
iii. Distance of travel required,
iv. Difficulty in setting up the product,
v. Size and number of products,
vi. Amount of staff required to set up/take down Inflatable.
b. Any changes made by the hirer to the event date or the number of products required may result in a change to the delivery charge.
DELIVERY TIMES
a. JWBeatsEntertainment will deliver the products to the hirer at a time agreed upon by both parties, but will endeavor to have the products set up before the time nominated by the hirer.
b. The hirer acknowledges that unforeseen delays may occur. If a delay occurs, JWBeatsEntertainment agrees to extend the hire period to compensate for lost time without additional charge.
c. The hirer agrees to provide adequate times for delivery of the Inflatable House before the event.
d. The hirer agrees that some products require a setup time of up to 2 hours or more before the scheduled event start time. JWBeatsEntertainment will advise the hirer of the required setup time and facilitate access for delivery. If access to the event site is not granted for the required setup time, JWBeatsEntertainment takes no responsibility for ensuring the products are ready by the event start time, and no refund will be provided for products not being ready on time.
SITE ACCESS
a. JWBeatsEntertainment will use a car and trailer or van, to deliver the products. The vehicle used will depend on the product, site conditions, and other job requirements for the day.
b. Some products require vehicle access for delivery. The hirer will be notified if vehicle access is necessary.
c. If vehicle access is required, the hirer must ensure a pathway clearance of no less than 4 meters wide. Failure to provide suitable vehicle clearance may result in the products not being set up, and the hirer forfeits any refund.
d. If vehicle access is not available and not required for delivery, JWBeatsEntertainment will use a trolley, and the hirer must ensure a pathway clearance of no less than 1 meter wide.
e. JWBeatsEntertainment will not deliver the products up or down flights of stairs. If stairs are present, the hirer must notify JWBeatsEntertainment and provide alternative access (e.g., lift). Failure to provide alternative access will result in products not being set up, and the hirer forfeits any refund.
f. The hirer is responsible for ensuring the delivery path is free from any obstructions. Failure to provide a clear pathway will result in products not being set up, and the hirer forfeits any refund.
g. The hirer is responsible for ensuring that the delivery path is suitable for transporting the products. If the delivery path is not suitable, JWBeatsEntertainment may refuse delivery, and the hirer forfeits any refund.
SETUP SITE
a. JWBeatsEntertainment will advise the hirer of the dimensions and space requirements for the products. The hirer agrees to provide adequate space for the products, allowing for inflating and deflating the products and for the safety and use of participants.
b. The hirer agrees to provide a site for setup free of underground utilities, cables, or pipes. JWBeatsEntertainment takes no responsibility for damages caused during setup or takedown of the products.
c. The hirer agrees to provide a flat, level surface for the products to be set up on. If the site is uneven or sloped, JWBeatsEntertainment may refuse to set up the products, and no refund will be provided.
Lawn Requirements:
The hirer must ensure that the lawn is freshly mowed before setup. Failure to do so may result in refusal to set up the product, and the hirer will forfeit any refund.
If the lawn has any prickles, the hirer must notify JWBeatsEntertainment in advance to discuss a suitable solution. If prickles are present and not disclosed, JWBeatsEntertainment reserves the right to refuse setup without a refund.
No animals or their waste are allowed on the lawn where the setup will take place. The hirer is responsible for cleaning and preparing the area prior to delivery.
d. The hirer must ensure that the setup site is free from debris, sharp objects, and any other potential hazards that could damage the products or pose a safety risk to participants.
e. If the products are being set up outdoors, the hirer must ensure that the setup site is not located under or near trees, power lines, or other obstructions that could interfere with the safe operation of the products.
f. The hirer must provide access to a power source within 20 meters of the setup site. If a power source is not available, the hirer may need to hire a generator at an additional cost.
g. JWBeatsEntertainment will not be held responsible for any delays or inability to set up the products due to site conditions that do not meet the requirements outlined in this agreement.
SUPERVISION AND SAFETY
a. The hirer agrees to supervise the use of the products at all times during the hire period. If supervision is not possible, the hirer must hire a supervisor from JWBeatsEntertainment at an additional cost.
b. The hirer is responsible for ensuring that all participants adhere to the safety guidelines provided by JWBeatsEntertainment. Failure to follow safety guidelines may result in injury or damage, for which the hirer will be held responsible.
c. The hirer must ensure that the maximum number of participants specified for each product is not exceeded.
d. The hirer must ensure that participants remove glasses, jewelry, and any sharp objects before using the products.
e. Smoking, any form of flame, pets, and other animals are not allowed on or near the products.
f. The hirer must ensure that participants do not engage in rough play, flips, or other dangerous activities while using the products.
g. In the event of strong winds or adverse weather conditions, the hirer must ensure that the use of the products is stopped immediately and that the products are deflated to prevent accidents or damage.
LIABILITY AND INSURANCE
a. The hirer acknowledges and agrees that JWBeatsEntertainment is not liable for any injury, loss, or damage arising from the use of the products during the hire period.
b. The hirer is responsible for any damage to the products caused by misuse, neglect, or failure to follow the safety guidelines provided by JWBeatsEntertainment.
c. The hirer agrees to indemnify JWBeatsEntertainment against any claims, damages, or expenses arising from the use of the products during the hire period.
COLLECTION AND RETURN
a. JWBeatsEntertainment will collect the products at the end of the hire period at a time agreed upon by both parties.
b. The hirer must ensure that the products are clean and free from any debris, food, or other materials before collection. A cleaning fee may be charged if the products are not returned in a clean condition.
c. The hirer must ensure that all accessories, including extension leads, blowers, and pegs, are collected and returned with the products.
d. Any damage or missing items will be charged to the hirer at the replacement cost.
TERMINATION
a. JWBeatsEntertainment reserves the right to terminate the agreement and collect the products immediately if the hirer breaches any terms of this agreement.
b. If the agreement is terminated due to the hirer's breach, no refund will be provided, and the hirer will be responsible for any additional costs incurred by JWBeatsEntertainment.
GOVERNING LAW
a. This agreement is governed by and construed in accordance with the laws of the state in which JWBeatsEntertainment operates.
b. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of that state.
ENTIRE AGREEMENT
a. This agreement constitutes the entire agreement between JWBeatsEntertainment and the hirer and supersedes any prior agreements, understandings, or representations, whether oral or written.
AMENDMENTS
a. Any amendments to this agreement must be made in writing and signed by both parties.
SEVERABILITY
a. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
DEFINITIONS The following definitions are used but not otherwise defined in this Agreement:
a. ‘Casualty Value’ means the market value of the equipment at the end of the term or when in relation to the total loss, the market value the equipment would have had at the end of the terms but for the total loss. The casualty value may be less than but will not be more than the original purchase price of the equipment.
b. ‘Products’ means Inflatable House or other items leased to the hirer from JWBeatsEntertainment. The term “Products” and “Inflatable House” are used interchangeably in this agreement.
c. ‘Total loss’ means any loss or damage that is not repairable or that would cost more to repair than the market value of the equipment.
d. ‘Schedule Event’ means the date stipulated in the invoice supplied to the hirer and confirmed by JWBeatsEntertainment.
e. ‘Scheduled Event time’ means the time that is provided by the hirer and stated in the invoice as a start time and finish time.
f. ‘High peak season’ includes but is not limited to October, November, December, January, February, school holidays, and public holidays.
